Terms & Conditions

These Terms & Conditions ("Terms") govern access to and use of the HeroAI platform, software, integrations, API connections, and related services (collectively, the "Service") provided by hostU, Inc. (d/b/a HeroAI) ("HeroAI," "we," "us").
By creating an account, connecting an integration, or using the Service in any capacity, the customer entity ("Customer") agrees to these Terms. If you do not agree to these Terms, you may not use the Service.
1. Definitions
- Account
- means an administrative user account created by Customer to access the Service.
- Authorized Users or Admins
- means individuals authorized by Customer to access the Service.
- Customer Data
- means all data submitted, transmitted, imported, or provided by Customer through the Service, including communications, emails, documents, property records, tenant information, PMS data, and configuration details.
- AI Processing
- means processing performed through machine learning or large language model systems to generate draft content or workflow outputs based on Customer Data.
- Integrations
- means third-party systems connected by Customer, including Entrata, Yardi, AppFolio, Gmail, Outlook, or other property management or communication platforms.
- Output
- means draft content or responses generated by the Service using AI Processing.
2. The Service
HeroAI provides software that assists property management teams by drafting responses, surfacing property data, and supporting operational workflows.
2.1 No Professional Advice
Output generated by the Service is intended for assistance only and does not constitute legal, financial, leasing, or professional advice. Customer is responsible for reviewing, approving, and validating all Output before use.
2.2 Human-in-the-Loop
Unless explicitly configured otherwise by Customer, the Service drafts content only.
HeroAI does not send communications automatically. All outbound messages require explicit user review and approval.
3. Accounts & Access Control
3.1 Account Creation
Customer must designate at least one Admin. Admins manage user access, integrations, and permissions.
3.2 Customer Responsibility
Customer is responsible for:
- Safeguarding login credentials
- Ensuring Authorized Users comply with these Terms
- Managing access permissions
HeroAI is not responsible for unauthorized access resulting from Customer's failure to secure credentials.
3.3 Tenant Isolation
Each Customer operates in a logically isolated environment. No Customer can access another Customer's data.
4. Customer Data
4.1 Ownership
Customer retains all right, title, and interest in Customer Data.
HeroAI does not claim ownership over Customer Data.
4.2 License to Provide the Service
Customer grants HeroAI a limited, non-exclusive license to access, process, store, and transmit Customer Data solely to provide and maintain the Service and improve Customer-specific performance.
4.3 No General AI Training
HeroAI does not use Customer Data, including Google user data, to train or improve generalized or shared AI models. Customer Data is processed only in accordance with these Terms and the Privacy Policy.
5. AI Processing & Output
Customer acknowledges that AI-generated Output may be inaccurate or incomplete. HeroAI does not guarantee accuracy or completeness of Output and is not responsible for decisions made based on Output.
HeroAI may use aggregated, anonymized technical metrics (excluding Customer Data) to improve platform performance.
6. Integrations
6.1 Authorization
By enabling an Integration, Customer authorizes HeroAI to access and process data from the third-party system as configured by Customer.
6.2 Third-Party Responsibility
Customer is responsible for:
- Maintaining valid licenses and permissions
- Complying with third-party terms
- Configuring integrations correctly
HeroAI is not responsible for third-party system availability or API limitations.
7. Acceptable Use
Customer may not:
- Use the Service for unlawful or deceptive purposes
- Attempt to reverse-engineer or compromise the Service
- Benchmark or scrape the Service without written permission
- Upload malicious code or misuse integrations
- Violate privacy or data protection laws
HeroAI may suspend or terminate access for violations.
8. Support & Availability
HeroAI will use commercially reasonable efforts to provide uptime and support.
HeroAI is not liable for interruptions caused by:
- Third-party outages
- Customer network or configuration issues
- Force majeure events
9. Fees & Payment
If applicable:
- Fees are billed according to agreed terms
- Late payments may result in suspension
- Fees paid are non-refundable unless otherwise agreed
10. Confidentiality
Each party agrees to protect the other party's confidential information and use it only as necessary to perform obligations under these Terms.
11. Intellectual Property
HeroAI retains all rights, title, and interest in:
- The Service and underlying software
- AI systems and infrastructure
- Documentation and improvements
No rights are granted except as expressly stated.
12. Termination
Either party may terminate these Terms:
- For material breach, or
- As otherwise agreed in writing
Upon termination:
- Customer access will be disabled
- Customer Data will be handled according to the Privacy Policy
- Obligations intended to survive termination will remain in effect
13. Limitation of Liability
To the maximum extent permitted by law:
- HeroAI is not liable for indirect, incidental, or consequential damages
- Total liability is limited to amounts paid by Customer in the 12 months preceding the claim
14. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
Any disputes will be resolved exclusively in the state or federal courts located in New York, NY.
15. Changes to These Terms
HeroAI may update these Terms from time to time.
Continued use of the Service constitutes acceptance of any updates.
